Clark Rubber’s Be-Safe Pool Fence.

A Queensland investigation has led to the nationwide recall of a pool fence after a child was able to reach through a gap and open the gate.

Clark Rubber’s Be-Safe Pool Fence – Portable Pool Fence Starter Kit was recalled in Queensland and then nationwide, following an investigation by the Queensland Building and Construction Commission.

Minister for Housing and Public Works Mick de Brenni said the product failed three tests of building product safety and Clark Rubber initially refused to issue the nationwide recall for the pool fence as requested by the QBCC.

On Wednesday the minister issued a statewide recall and Clark Rubber pulled the product from shelves across the country.

“It has failed the relevant Australian Standard for pool safety, it has failed to meet the standard required by Queensland’s non-conforming building product legislation, and it’s simply failed community standards,” Mr De Brenni said.

“The gate system of the kit failed the pool safety standard on numerous occasions but, significantly, the area of biggest concern is the latch that is required to be self-latching when it isn’t, as well as gaps in the fence allowing prohibited access to the latch.

“QBCC tests found that the latch doesn’t close and secure itself properly and this completely defeats its safety purpose.

“In January this year, a consumer contacted the QBCC after a child was able to reach inside the fence and undo the latch and open the gate.

“This is an accident waiting to happen, and I’m pleased the QBCC acted swiftly to investigate and advise me of the issue.”
