A teenager is suing an abortion clinic on behalf of his unborn child who he said was terminated against his wishes.

Ryan Magers, 19, claims his girlfriend terminated her pregnancy when she was six weeks’ pregnant, even though he begged her not to, according to legal documents.

In the first lawsuit of its kind, Magers is suing on behalf of the aborted fetus “Baby Roe” and himself in an Alabama court in the US, Fox News reported.

“Baby Roe’s innocent life was taken by the profiteering of the Alabama Women’s Centre and while no court will be able to bring Baby Roe back to life, we will seek the fullest extent of justice on behalf of Baby Roe and Baby Roe’s father,” Attorney Brent Helms said in a statement.

“The time is ripe for consistency in Alabama’s jurisprudence: either we fully acknowledge the personhood of the unborn or we cherry pick which innocents we protect and which ones we trash for profit.”

Judge Frank Barger allowed the teen to name his aborted child as a co-plaintiff in his case against the women’s clinic four months after the state passed a law that gave fetuses the same legal rights as any other person.

The teen’s attorney believed the case could make it to the Alabama Supreme Court.

The case has alarmed pro-choice activists who say it undermines women’s rights.

  • Nice to see father’s who love their unborn children so much, something I missed out on. Very sad, but I really don’t know if he could’ve stopped her. She obviously had her reasons. Perhaps they are not a suited couple.

  • I think it is great that he took a stand – but at the end of the day, it is up to the pregnant woman to make the final decision.

  • I know it isn’t fair on the man to not have a say, but it;s the womens body and life that changes more so ultimately its her choice. Very easy for him to say to keep the baby when it isnt his body

  • Sorry, but it’s a woman’s body and her decision. She is the one that sacrifices EVERYTHING for this baby. If she wasn’t ready or being coerced, it’s not right.

  • It’s truly difficult when a man wants a pregnancy, but since the wOman has to carry it (and so often is left with the baby), I think she should have the ultimate say.

  • This is a very slippery slope. If an abusive man can use this lawsuit to control his partner and what she does it could cause a lot of heartache.

  • What a horrible situation. Very difficult to take a stand about it. Of course it’s the woman’s body, but the father has his rights too. :-(

  • Abortion is such a minefield. Everyone seems to focus on the mum to be/pregnant woman and what she wants and needs. But truth be told, there are the partners/dads, grandparents. So much to be considered. Honestly, if it were me and I couldn’t cope with the thought of being a mum, I would rather give birth and letting dad raise the baby if that’s what he wants. Better then killing the baby.

  • He should have definitely been involved in the decision, he may have raised that little baby by himself, she could have signed away her rights. I am pro choice but I also believe all should be involved in the decision or the discussion first

  • Since my son arrived 3 years ago I have thought a lot about what if he was in this situation, and what his rights would be. I want to applaud this young man. His child was taken from him and nothing will ever change that. But he is taking a stand for father everywhere! Hopefully the advancements in artificial uteruses means that men who want babies that the women don’t, are able to keep them, without the woman having to take part. It’s heartbreaking that the baby was aborted. (If you want to argue prob birth or womens rights etc, please do it in your own post. You have your opinion and I have mine. Arguing isn’t going to change anybody’s mind so let’s just leave it at that!)

  • It’s upsetting it had to come to this. Ultimately it is her body and her choice end of the day but i feel she should’ve spoke to him more about it

  • Very sad for the father but perhaps as she took her matters into her own hands then they may not have been in a very formal type of relationship where she felt they both had an equal say. Don’t know, it’s a tricky one, anything could have been big deciding factors….future education/stability/finance/somewhere to live even.
