A couple claim they went to a fertility clinic and fell pregnant with someone elses baby!

The New York couple who tried for years to get pregnant suffered the mother of all mix-ups once they finally succeeded — giving birth to someone else’s babies, thanks to a bungling Los Angeles fertility clinic, a stunning new lawsuit claims.

Married in 2012, the Asian husband and wife — identified in court papers only as Y.Z. and A.P. — turned to CHA Fertility Center, when their countless attempts, both natural and with artificial insemination, failed, the New York Post reports.

The New York couple made the trip to the west coast in January 2018 to meet with Berger and Hong, and eventually underwent a months-long regimen of medicines, vitamins, tests and procedures that yielded eight embryos.

In all, they spent $100,000 on facility, specialist and doctors fees, medication, lab expenses and travel costs, the couple claimed.

In July 2018, A.P. attempted to have an embryo implanted at the Los Angeles facility, but it didn’t work, the couple said in its Brooklyn federal court lawsuit.

A month later, they were ready to try again, and CHA thawed two of the couple’s female embryos for another attempt.

The two “were ecstatic to learn that after years of trying to conceive, they had success and were pregnant with twins,” according to court papers.

The first sign of a mixup

Ultrasound technicians kept telling the couple that A.P. was carrying twin boys, prompting the “confused” pair to find out why.

They were told it was just an error on the sonogram and the doctor and clinic owner “assured [A.P. and Y.Z.] that they were having girls and that nothing was wrong.”

The birth

On March 30, 2019, A.P. went to a New York hospital. The next day, she gave birth via a cesarean section.

Both babies were boys — and neither shared Y.Z. and A.P.’s Asian ethnicity, the couple charges.

CHA personnel, including Hong, flew to New York to conduct genetic tests that confirmed the newborns weren’t genetically related to Y.Z. and A.P.

“The testing also confirmed that the two male babies were not genetically related to each other,” the couple alleges.

The heartbreaking loss

Y.Z. and A.P. were then forced to give custody of each infant to their respective biological parents, who were also clients of CHA.

Heartbroken and embarrassed, Y.Z. and A.P. haven’t told most of their friends and relatives about the “unimaginable mishap”.

The couple “could not find the courage and the way to tell others about their devastating loss,” they claim.

For A.P. and Y.Z., the experience of delivering the babies and then losing them has left the couple with “permanent emotional injuries from which they will not recover,” they said in their legal claim.

What an horrific ordeal. That poor couple.

  • This is terrible. We underwent IVF and they double checked EVERYTHING multiple times, it seemed that every 5 minutes they were double checking our names. It is terrifying to think that this can happen, who is held accountable for this sort of thing?

  • There was at least 2 bungles in this case. Other Mums could have suffered the same disaster. However it may not be realised quickly if the babies are the same authenticity as the new parents.

  • Whenever you have humans doing anything technical, there will always be human error. I cannot imagine the greif that couple would be going through.

  • I don’t even know how something like this can happen. To go through the whole thing only to have the babies taken away from you would tear your heart out. I hope they can get their babies they want so badly soon

  • This is a devastating error for them to have gone through. I know it won’t change anything but I think the parents who ended up taking the babies should have to pay all of the medical bills and compensation as well as the clinic

  • This is horrible! In all honesty after a mother has carried the babies all that time she should have had the option to keep them even if they weren’t biologically hers. I am sure the other couple must have had other embryos and most likely wouldn’t have missed the one. How disappointing for them.


    • What the hell ?? You cant be serious !!! No that woman shouldn’t just be able to keep them babies and it doesn’t matter if the other couples had other embyos doesnt mean they want their child raised by other people and also doesn’t mean the asian couple want to raise non asian babies …
      Ive been through ivf and i had my left over embryo donated to science as I couldn’t stand the thought of having a bio child out there somewhere

  • This is your absolutely worst nightmare for an IVF couple. Just horrific and traumatic and something that will stay with them. Also managed to ruin the whole experience for them.

  • Very sad for the couple they will be fine and God will give tham there own babies.


    • Oh please, don’t patronize and insult this couple, if this so called god was real and gunna give them babies (btw, sex does it, not god) they would never have been trying ivf
